Terms of Service

1. Acceptance of Terms

By creating an account, purchasing a pass, or using the Go Fan Cam platform (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use our Service. These Terms constitute a legally binding agreement between you (“Client”, “you”) and Go Fan Cam (“we”, “us”).

2. Definitions

  • Link — A persistent fan cam activation tied to one screen or venue. Each link has its own permanent QR code, admin page, branding settings, and session history.
  • Session — A time-bounded period during which fans can submit photos through a link. Sessions are started and stopped by the Client via the admin dashboard.
  • Subscription — An ongoing monthly or annual agreement granting access to the Service at the tier and link count specified in the plan selected at checkout.
  • Pass — A one-off, time-limited access grant (Day Pass: 24 hours; Week Pass: 7 days) with a defined link count.
  • Fan — An event attendee who voluntarily submits a photo through the fan-facing camera interface.

3. Acceptable Use Policy

Permitted uses:

  • Operating fan cam activations at live sports events, entertainment events, corporate events, and similar gatherings
  • Displaying approved fan photos on big screens, social media, and promotional materials within the scope of the consent obtained
  • Using sponsor tracking and analytics features to report on engagement

Prohibited uses:

  • Capturing, storing, or displaying images of individuals without their explicit consent
  • Using the Service to collect images for surveillance, facial recognition, or law enforcement purposes
  • Uploading or displaying content that is unlawful, defamatory, obscene, or harmful
  • Attempting to circumvent plan limits, rate limits, or access restrictions
  • Reselling, sublicensing, or white-labelling the Service to third parties without written permission
  • Using the Service in any manner that violates applicable data protection law

4. Data Controller Responsibility

You are the Data Controller for fan data collected through your links. Go Fan Cam acts as the Data Processor on your behalf, processing fan photos and consent records only on your documented instructions. You are responsible for:

  • Ensuring the consent text displayed to fans is accurate, lawful, and appropriate for your jurisdiction
  • Maintaining a lawful basis for processing fan data under GDPR, CCPA, or applicable law
  • Responding to data subject access requests from fans (we will assist on request)
  • Conducting a Data Protection Impact Assessment (DPIA) where required by regulation

A Data Processing Agreement is accepted at sign-up via a dedicated checkbox and governs the processing relationship between you and Go Fan Cam.

5. Children's Data (COPPA)

COPPA Notice: If you operate fan cam at events involving children under 13, you are responsible for obtaining verifiable parental consent before any child's photo is captured. Go Fan Cam provides configurable minimum age controls and youth event flags in the admin dashboard. It is your obligation to ensure compliance with the Children's Online Privacy Protection Act (COPPA), the UK Age Appropriate Design Code, and equivalent regulations in your jurisdiction.

Go Fan Cam does not knowingly collect personal data from children under 13 without the Client's confirmation that appropriate parental consent has been obtained.

6. Subscriptions & Billing

  • Auto-renewal: Subscriptions renew automatically at the end of each billing cycle (monthly or annually) unless cancelled before the renewal date.
  • Billing: All payments are processed by Stripe. Your payment method on file is charged at the start of each billing cycle.
  • Plan changes: You may upgrade at any time (pro-rated). Downgrades take effect at the start of the next billing cycle.
  • Cancellation: Cancel at any time via your account settings. Access continues until the end of the current billing period. No cancellation fees.

7. Refund Policy

  • Annual subscriptions: 14-day pro-rata refund from the date of payment. After 14 days, no refund for the remainder of the annual term.
  • Monthly subscriptions: No refund for the current billing cycle. Cancellation takes effect at the end of the cycle.
  • Day Pass & Week Pass: Non-refundable once activated. If a pass has not been activated, you may request a refund within 7 days of purchase.

8. Feature Deactivation on Expiry

When a subscription expires or is cancelled and the billing period ends:

  • Active sessions are closed. No new fan photos can be submitted.
  • Your branding settings, session history, and analytics are frozen in a read-only state.
  • The browser source URL displays a branded holding page (not a broken link).
  • If you resubscribe within 90 days, all settings and data are restored automatically.
  • After 90 days, account data may be permanently deleted in accordance with our retention schedule.

9. Intellectual Property

  • Client content: You retain ownership of your logos, branding assets, sponsor creatives, and any custom frames uploaded to the platform.
  • Fan photos: Fan photos remain the property of the individuals depicted. Neither you nor Go Fan Cam claim ownership of fan images beyond the limited licence granted by fan consent.
  • Platform: Go Fan Cam retains all rights to the platform, software, code, templates, UI design, and documentation. No licence is granted to you beyond the scope of your subscription.

10. Limitation of Liability

To the maximum extent permitted by law, Go Fan Cam's total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the total fees paid by you in the 12 months immediately preceding the claim.

Go Fan Cam shall not be liable for: (a) indirect, incidental, special, consequential, or punitive damages; (b) loss of profits, revenue, data, or goodwill; (c) any claims arising from your failure to obtain appropriate consent from fans; (d) service interruptions, downtime, or data loss beyond our reasonable control.

11. Indemnification

You agree to indemnify, defend, and hold harmless Go Fan Cam, its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your failure to comply with applicable data protection law; (d) any claim by a fan or third party relating to content you captured, displayed, or shared using the Service.

12. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for losses arising from downtime, maintenance windows, or force majeure events. SLA guarantees are available to League-tier clients under separate agreement.

13. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your data will be retained for 30 days in read-only state before permanent deletion. You may request immediate deletion by contacting privacy@gofancam.com.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days.
